HDB owners should be familiar with the Minimum Occupation Period. All HDB owners should have lived in their HDB flat for 5 years before they are legally eligible to rent out the entire flat. In addition, only Singaporeans are allowed to rent out entire units, provided that their HDB flat is 3-bedroom or larger. However, HDB owners are allowed to sublet, or rent out a portion of their flat during the MOP as long as they live together with tenants during the subletting period. HDB penalises homeowners who break this rule severely, by revoking all subletting registrations with immediate effect. Keep in mind that all tenants must hold a valid student pass, work permit, employment pass, S Pass, Dependant Pass, or Long-Term Social Visit Pass. In addition, all construction, manufacturing, marine, and processing work permit holders must be from Malaysia. Apart from Malaysians, the Non-Citizen Quota applies when renting out to foreigners (this includes SPRs). The standard quota is 8% for the neighbourhood and 11% for the block. Finally, short-term leases are not allowed under HDB’s regulations. This means that running an Airbnb business in a HDB flat is not legal. All tenants have to rent their flat of a minimum of six months per application.
